Terms of Service

1. Acceptance of terms

By accessing or using Craftlytics (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Michael Melanson ("we", "us", or "our"), the operator of Craftlytics.

2. Description of service

Craftlytics is a web-based analytics platform for craft business owners. The Service connects to third-party marketplaces (such as Ravelry) to import sales data and provide business analytics, including revenue tracking, customer insights, and product performance metrics.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.

3. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Account registration and responsibilities

When you create an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorised access to your account
  • Accept responsibility for all activity that occurs under your account

You may not share your account credentials with others or allow multiple people to use a single account.

5. Free trial, subscription, and payment

Free trial

New accounts include a free trial period of one month. During the trial, you have full access to the Service at no charge. At the end of the trial, you must subscribe to a paid plan to continue using the Service. No payment information is required to start a trial.

Subscription

After the trial period, continued access to the Service requires a paid subscription at $20 CAD per month. Subscriptions are billed monthly through our payment processors (Stripe or PayPal). You must actively opt in to subscribe; billing does not begin automatically.

Refund policy

All subscription fees are non-refundable. You may cancel your subscription at any time, and you will retain access until the end of your current billing period.

6. User data and privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA).

You retain ownership of all data you provide to the Service. We do not sell your data to third parties.

7. Acceptable use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Attempt to gain unauthorised access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service for any fraudulent or deceptive purpose
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Use automated tools (bots, scrapers) to access the Service beyond its intended API integrations

8. Intellectual property

The Service, including its design, code, features, and documentation, is owned by Michael Melanson and is protected by Canadian and international intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it as described herein.

You retain all rights to your data. By using the Service, you grant us a limited licence to process your data solely for the purpose of providing the Service to you.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data or analytics provided will be accurate or complete. The Service relies on data from third-party platforms (such as Ravelry), and we are not responsible for the accuracy or availability of that data.

10. Limitation of liability

To the maximum extent permitted by applicable law, Michael Melanson shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from your use of the Service shall not exceed the amount you paid us in subscription fees during the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Michael Melanson from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your violation of these Terms.

12. Termination

You may terminate your account at any time through the Service's settings page. Upon termination, your data will be permanently deleted, except where retention is required by law.

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, with or without prior notice.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

14. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario.
